Applies to: England
Eviction, possession and notice periods
Since 1 May 2026, private landlords in England can no longer use section 21 'no fault' evictions. They must use a legal ground for possession under section 8, and usually need a court order.
- Grounds include, for example, rent arrears, antisocial behaviour, or the landlord wanting to sell or move in.
- Landlords cannot use the selling or moving-in grounds in the first 12 months of a tenancy, and must give 4 months' notice for them.
- Notice periods differ by ground. Only a court can order you to leave — get advice quickly if you receive a notice.
